This website (medonline.co.nz) is owned and operated by MedOnline. These terms apply to this website and GP services accessed by booking on this website. Your continued use of this website and the services provided through MedOnline constitute your acceptance to these terms and conditions.
MedOnline reserves the right to modify its terms, conditions and services at any time.
TO use our servces you must be a New Zealand citizen, resident or visiting New Zealand. You must be 18 years old or over. In some situations we can provide services to those with New Zealand Working Visas, and non-residents living in New Zealand (see NZ Eligibilty conditions from the Ministry of Health - we will let you know if you are not eligible for funded prescriptions when you submit your Eligibility form online). You must also have a current valid Government issued form of photographic identification such as a Passport or NZ Drivers Licence that can be visualised during a consultation if requested.
The advice given through MedOnline is provided by a New Zealand Registered Medical Practitioner (“MedOnline Doctor”). They operate under a Code of Ethics which is the same code of ethics as a regular doctor would have if they were seeing a patient face to face.
MedOnline is not a pharmacy, it does not directly dispense medicines. As a doctor we can of course provide your nominated pharmacy with a script which will enable you to then secure your own medicines, or we can arrange delivery of those prescriptions directly to you from Zoom Pharmacy.
Following consultation, MedOnline will inform your nominated General Practitioner of the consultation and of the medications prescribed (if any). If however you either do not nominate a General Practitioner or you do not give us the authorisation to contact that General Practitioner it will be your responsibility to inform your existing General Practitioner of any medications prescribed.
Prior to the prescribing of some medications, your MedOnline Doctor may require you to have your blood pressure checked. MedOnline or the MedOnline Doctor will advise you if this is a requirement prior to the issuing of any medication. The taking of your blood pressure will be your responsibility and can be done, for example at pharmacies or you can purchase a home blood pressure cuff suitable for home use.
You agree that any product, medicine or medication that MedOnline Doctors prescribe will be solely used for your own personal use and that you will not allow any other person to take, use or have access to that medication. You agree that if medication is provided or delivered to you that you will only take that medication in conjunction with any other medication that you have already disclosed to the MedOnline Doctor prior to the issuing of the prescription. You agree that before taking any medication prescribed to you, you will read all information provided to you by the MedOnline Doctor, the dispensing Pharmacist or by the manufacturer of the product and will follow that advice. If there is any conflict between the advice provided by the MedOnline Doctor and the manufacturer of the product or the pharmacist you must contact the MedOnline Doctor before taking the medication.
If while taking medication you suffer any noticeable side effects that are causing you concern, you must re-book an appointment with the MedOnline Doctor to allow that medical practitioner to monitor the effect of the medications prescribed to you, or you must see your usual General Practitioner for advice. For urgent care, in New Zealand dial 111 and ask for the ambulance.
If during the course of your consultation with the MedOnline doctor, transmission fails, your MedOnline Doctor may contact you by telephone or some other method in order to complete the consultation. If the cause of the communication failure is technical, you may be contacted by a member of the MedOnline support team to assist you with your reconnection.
If you use our video facility, you must not attempt to record the consultation, whether visually or by audio or take screenshots or copies of images of that meeting. You must not abuse, intimidate or threaten those people using the facility or engage in behaviour which is offensive. We reserve the right to terminate any consultation if you fail to comply with these terms.
In some circumstances, an online consultation will not be appropriate for your particular problem. MedOnline reserves the right to discontinue the provision of advice, or the prescribing or delivery of medication to you at any time. MedOnline may also withdraw, suspend or discontinue any of its services to you at any time without providing a reason to you.
You agree that all information that you provide to the MedOnline Doctor will be true and complete to the best of your knowledge, and that you will not intentionally omit to provide information that could reasonably be judged to be relevant to the MedOnline Doctors in providing their services to you. This includes any allergic reactions, or previous medical experiences or treatments.
MedOnline charges a fee on booking a medical consult. If you are unable to attend this appointment we will take all reasonable steps to rebook this appointment, however if you miss the appointment you will need to pay to book a new one. (You are booking a doctors time, if you do not turn up we cannot re-use that time to see someone else!) If the consulting MedOnline Doctor considers it appropriate (e.g. if they have been unable to carry out a safe or effective consult they may decide to refund the fee - less transaction expenses of 5%). If you email us to cancel the appointment and give us more than 1 working days notice (so we can rebook the appointment) we will refund the fee (less transaction expenses of 5%).
As part of your registration with us, you are required to provide personal identifiable information. It is your responsibility to keep that information up to date with us so that it is complete and accurate at all times.
You shall not impersonate another person while using the MedOnline facility. Do not complete the questionnaires or have a consultation on behalf of anyone else other than yourself personally.
You must take sole responsibility for the communications you make between yourself and the MedOnline Doctor during the consultation. MedOnline makes no warranties whether express or implied as to the content of that consultation. Doctor/patient consultations are private and protected by law, records will be kept of the consultation. Emails may be recorded by MedOnline for medical and legal reference. These records will be stored securely.
Any emails or prescriptions are intended to be only read by the named recipient as they contain information which is medically confidential. It is your responsibility to ensure the security of your computer, emails and prescriptions.
MedOnline stores its data and records in both paper and digital forms. MedOnline has a legal obligation to protect all patient confidential data. However, in order for MedOnline to provide its services, it must share some of the information you provide to them with other Doctors, health professionals, and non-medical staff who may themselves store some information about you on their own files. MedOnline reserves the right to use some of the information it collects, to verify your identity, for legal compliance, for financial and statistical information, for law enforcement, to facilitate court proceedings, to ensure the safety of MedOnline and its users, to enforce or apply its terms and conditions or to protect the property rights of MedOnline. It might also use some information for internal research purposes, to maintain its website, as part of the payment protocols and for providing to you newsletters and promotions. Where MedOnline uses third parties to undertake services, it will require that third party to undertake strict precautions to protect your information against unauthorised use or disclosure. Your rights are protected by the Code of Health and Disability Services Consumers Rights, the Health Information Privacy Code 1994 and you have at all times the right to obtain and correct any information that we hold about you. You agree that you will not share your user name and password with anyone. You acknowledge that you will take all reasonable steps to ensure that a third party does not gain access to your account and that your software and computer facilities are suitably protected from hazards by firewalls, antivirus software and other security applications.
The website and the services provided by MedOnline may be interrupted from time to time or contain errors in the website, server, hardware or software. They cannot guarantee the services will be free from any viruses or other malware. MedOnline will not be liable for any loss or damage resulting from the transmission of data through this website or by email.
If MedOnline have reason to believe that you have used another person’s payment card, bank account or payment details without their permission or knowledge, it may disclose information relating to the transaction to that other person, law enforcement agencies or their bank.
MedOnline does not warrant that any product description or advice contained within this website is necessarily accurate, current, reliable, complete or error free. This is particularly so where the information is provided to MedOnline by third parties. Any other websites or links that MedOnline provide to you it does not endorse or approve and has no responsibility for the content of. They are provided for your information only.
MedOnline has no liability for any lack of performance, unavailability or failure of its services, the website or for any failure of MedOnline to comply with these terms and conditions where they arise from any cause beyond the reasonable control of MedOnline.
To the maximum extent possible and applicable by the laws of New Zealand, under no circumstances will MedOnline or a MedOnline Doctor be held liable, for any implied warranties, conditions or terms, and will not be liable for any loss or damage (whether foreseen or unforeseen) relating to loss of emotional wellbeing, loss of data, loss of revenue or anticipated profits or savings, loss of business, loss of opportunity, loss of goodwill, or injury to reputation. MedOnline will not be held liable for losses suffered to third parties or any direct or indirect general, consequential, special or exemplary damages arising from the services provided to you regardless of the form of action.
In return for you using this site, you agree to release MedOnline from any claims that you may have now or later against MedOnline and will at all times in the future indemnify them against all proceedings, actions, claims or demands made by any person whether for personal injury, (including death and disability) or otherwise and whether occasioned by negligence, breach of a statutory duty, tort, equity, breach of contract or otherwise suffered as a result of or in connection with you using this website and facility.
All prices are shown in NZ dollars and inclusive of GST where applicable. We protect your credit and debit card information during transmission by using the SSL protocol, which encrypts your information when transmitted over the internet.
This site and the information contained within it are the property of MedOnline or its suppliers. All MedOnline’s information and data is protected by the laws of copyright, trademark and other intellectual property rights. The compilation, organisation or display of the content of this site, the software and the design are the exclusive property of MedOnline.
If any of these terms and conditions are deemed to be illegal, invalid or otherwise unenforceable, then to the maximum extent permissible the provision which is considered illegal, invalid or unenforceable shall be firstly redacted to the level where it is no longer illegal, invalid or unenforceable or, if that can not be achieved, severed and deleted from these Terms and Conditions, but the remaining Terms and Conditions shall survive and remain in full force and effect.
These Terms and Conditions are governed by and to be construed in accordance with the laws of New Zealand and you irrevocably submit to the exclusive jurisdiction of the Courts of New Zealand.
